Terms & Conditions
Agreeing to these Terms & Conditions
By submitting your registration for the Dr. Nick’s White & Healthy Partner Program, you are agreeing to abide by the following terms and conditions. To remove yourself from the program, please e-mail info@whiteandhealthy.com stating your desire to be removed and include your name and registration number.
How to Earn Commissions
To earn commissions on referral sales of Dr. Nick’s White & Healthy products you must refer customers to the www.whiteandhealthy.com web site to purchase products. Instruct your referral customers to enter your referral number in the box provided on the order page. You will earn commission on purchases when your referral number is entered at the time of purchase only. Sales made without your referral code are ineligible for commission, and commissions will not be paid on a retroactive basis.
Personal Use
Products purchased for personal use (shipped to your registered address, made in your name or utilizing a credit card in your name) are not eligible for commission.
Payments
Commission will be paid on a monthly basis, net of returns, for valid sales made during the preceding calendar month. Commissions will be processed on or about the 15th of every month for the preceding calendar month. Payment will be made via check mailed via U.S. Postal Service or other carrier chosen at the sole discretion of White & Healthy to the address provided when you registered for the program.
Minimum Production for Payment
Commissions must exceed $10 to receive payment. Commissions of less than $10 will accrue until this minimum level is reached or for a period of 180 days. If your referral sales do not generate the minimum required commission within this period, these commissions will be forfeit.
Valid Sales
Valid sales are those made in good faith through the White & Healthy web site using a valid credit card and when an valid referral code is entered at time of purchase. Commission will not be paid on fraudulent sales, invalid or dishonored credit cards, telephone sales, sales made in or by retail store partners, trade show sales, replacement product, free samples or any transaction other than a consumer purchase through the White & Healthy web site with a valid referral code entered at time of purchase.
Dispute Resolution
If at any time you believe an error has been made, please e-mail info@whiteandhealthy.com clearly stating your concern, provide any appropriate substantiation and desired resolution. As valued partners, we strive to reconcile all disputes in a timely and amicable manner. In all disputes, the decision of White & Healthy management shall be final.
Appropriate Promotion
You may promote Dr. Nick’s White & Healthy products in any lawful manner you choose, except where such promotion directly interferes with the sales of a retail partner. (For example, you may not go to a retail store selling Dr. Nick’s White & Healthy products in an attempt to direct sales away from the retail store.) Inappropriate or unlawful promotion is grounds for termination from the program.
Appropriate promotion includes, but is not limited to, word of mouth, distributing literature, placing advertisements, holding home parties and the like. If you have suggestions on how Dr. Nick’s White & Healthy could assist in these efforts, please e-mail info@whiteandhealthy.com
Misrepresentation
You are prohibited from making misleading statements about the products or misrepresenting the features and benefits. Only those claims made in official Dr. Nick’s White & Healthy publications may be utilized. Misrepresenting the products is grounds for termination from the program.
Independent Status
You understand and agree that your role is solely as an independent participant in the Partner Program and not as an employee of Dr. Nick’s White & Healthy. You are prohibited from representing yourself as an employee or being affiliated with the company in any manner other than as a participant in the Partner Program. Your participation in the Partner Program is solely at your own risk and Dr. Nick’s White & Healthy takes no responsibility for any accident, injury, legal action or any other consequence that may occur because of your participation in the Partner Program, and you agree to hold Dr. Nick’s White & Healthy harmless for any such occurrences.
Right of Termination and Modification
Dr. Nick’s White & Healthy may terminate or modify the Partner Program at any time without advanced notice. Such modifications of the program will be posted on the Partner Program section of the White & Healthy web site, and e-mailed to program participants using the e-mail account submitted when registering.
Violation of the terms and conditions detailed in this document may result in termination from the program. Commissions determined to have been earned through fraudulent means or by misrepresentation will be forfeit, at the sole discretion of the management of Dr. Nick’s White & Healthy.
Not a Contract
These terms and conditions are simply an outline of Partner Program policies and do not constitute a contract between Dr. Nick’s White & Healthy and anyone else.
